These Terms and Conditions of Use (“Agreement”) is a legal agreement between User (hereinafter referred to as “User”, “You”, “Yourself”, “Your”) and  Unshattered Counseling Services LLC (hereinafter referred to as “Website Owner, We, or Our”), the owner and developer of www.brittneymscott.com.

These terms and conditions are subject to change by the Website Owner at any time and at our discretion without notice by updating this posting. You must review these Terms on a regular basis to keep Yourself informed of any changes.

By accessing, downloading, installing, or using this website whether or not you become a registered user , You agree to be bound by this Agreement, which You acknowledge that You have read and understood.

By purchasing or using any of our Programs, Products or Services, you agree to abide by these Terms of Conditions as well as our Disclaimer and Privacy Policy, and any other terms and conditions that may apply, and are you are required to act in accordance with them. Accessing, purchasing or using our Programs, Products, Services or Program Materials, in any manner constitutes use of the Program, Products, Services and Program Materials, and your agreement to be bound by these Terms of Use.

All of our Programs, Products, Services and Program Materials are intended solely for users who are eighteen (18) years of age or older. Any registration by, use of or access to any Program, Product, Service or Program Materials by anyone under age 18 is unauthorized, unlicensed and in violation of these Terms of Use. By accessing or using our Programs, Products, or Services or our Program Materials, you represent and warrant that you are at least 18 years old.

 
ACCOUNT CREATION


In order to use the Service, you may be required to provide information about yourself including your name, email address, username and password, and other personal information. You agree that any registration information you give to Unshattered Counseling Services LLC, will always be accurate, correct, and up to date. You must not impersonate someone else or provide account information or an email address other than your own. Your account must not be used for any illegal or unauthorized purpose. You must not, in the use of these  Programs, Products, Services, violate any laws in your jurisdiction.


REFUSAL OF SERVICE


The  Programs, Products, and Services are offered subject to our acceptance of your order or requests. We reserve the right to refuse service to any order, person or entity, without the obligation to assign reason for doing so. Some of the  Programs, Products, and Services offered are application based, and no order is deemed accepted by us until payment has been processed. We may at any time change or discontinue any aspect or feature of this website or  Programs, Products, Services, subject to us fulfilling our previous responsibilities to you based on acceptance of your payment.

Security

We do not store any whole credit card numbers or payment information, and instead, these are processed through third-party processors such as Stripe and PayPal. By utilizing these payment processors to gain access to Your purchases, You indemnify Us and instead assume any and all risk or liability for the security of the payment details, and agree to be bound by the third-party payment processor’s applicable terms and conditions of use.

 

Confidentiality

It is agreed that all personal information given to Unshattered Counseling Services LLC, will be kept confidential with the following exceptions: (1) You actively chose to post your personal information for others to see;  (2) you have harassed another person via any service provided by Unshattered Counseling Services LLC in which case the confidentiality clause contained in this Agreement is rendered null and void.


RETURNS, REFUNDS, AND CANCELLATIONS

If you purchase ‘Vibrant Vocal and Valued’ and you change your mind about starting the Program, refunds will be honored, if you have NOT started the program and viewed the Program Material. After the start date of the program, refunds will NOT be available. 

 If you purchase Reconnection Rescue, a full refund will be honored 48 hours before your first scheduled session with Brittney Scott. After the 48 hour window from your first scheduled session, you will receive a refund minus the first session fee ($300).

PAYMENTS

The investment for Unshattered Counseling Services LLC programs and products vary. You agree to pay the full amount indicated on the checkout page. Please contact us if you are unsure about your payment options or requirements. You will receive a receipt upon purchase. 

 

Chargebacks

In the event of a chargeback attempt, You expressly agree to forfeit any and all of Our the materials afforded to You in exchange for Your original purchase. We reserve the right to present proof of Your access and these Terms and Conditions of Use to the financial institution investigating the dispute.

 

Recurring payments

If You have signed up for a payment plan, You hereby authorize Our continued access to Your financial information stored by Our third-party financial processing company referenced in this Agreement until Your payment plan is complete, as set forth in Your acceptance of the purchase terms upon checkout.

 

 SOCIAL MEDIA GROUPS AND COMMUNITIES

Many of our communities are designated to clients only. You will have access to a private community (primarily on Facebook) based on your enrollment in a specific program.

We do not condone or allow any form of racism, homophobia, bullying, or bigotry of any kind in our groups. If we feel like you are a threat to our members, you will be removed from the group immediately with no warning. We want people to feel safe when using our groups. 

 

DATA POLICY & SAFTEY

We represent and warrant that we process any collected personal data in accordance with the applicable statutory provisions. For details on how we collect, store, process and protect personal data please refer to our Privacy Policy.

 

INTELLECTUAL PROPERTY

You acknowledge and agree that all content and materials available on this web site and any Unshattered Counseling Services sites are protected by copyrights, trademarks, service marks, patents, trade secrets, or other proprietary rights and laws. Except as expressly authorized byUnshattered Counseling Services LLC, you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from such materials or content. 

Digital Product Usage & Limited License 

Any and all materials, paid or free, that You access on this or any related domains are the sole ownership or licensed use of Unshattered Counseling Services LLC.

 You are not allowed to reproduce any part of Our product(s) or related communications.

You are receiving a limited, non-transferable, non-exclusive, revocable license for non-commercial use only, in order to access any content or materials in the products You have paid for or opted to receive. 

If you violate this license by giving or selling a copy of Our template(s)/product(s) to anyone, We reserve the right to send You a bill for the licenses you have sent to others and revoke your access to Our template(s)/product(s) permanently.

You may:

  • Access Your purchases for Your personal use or use in Your business for non-commercial purposes.

  • Download and/or print any purchases for Your personal use or in Your business for non-commercial purposes.

You may NOT:
